1. Who we are
Goodsoko (goodsoko.com) is operated by [Goodsoko Limited], a company registered in Kenya (registration number [●]), of [physical address], Nairobi ("Goodsoko", "we", "us"). By creating an account or using Goodsoko you agree to these Terms and to our Privacy policy.
2. What Goodsoko is, and isn't
Goodsoko is an online classifieds marketplace where sellers advertise items and services and buyers contact them. We are not a party to any sale. We don't own, inspect or deliver the items advertised, we don't hold buyers' money, and we don't guarantee the quality, safety, legality or description of any item, or that a buyer or seller will complete a deal. Any agreement is between the buyer and the seller.
3. Your account
- You must be at least 18 years old and able to enter a binding contract.
- Give accurate details and keep your phone number and email current. You're responsible for everything done through your account; keep your password and sign-in codes private. Goodsoko staff will never ask for them.
- One person or business may hold one seller account unless we agree otherwise.
- Tell us straight away at [[email protected]] if you think your account has been misused.
4. Posting ads
- Only advertise items you own or are authorised to sell, at a genuine price, in the right category and location, with your own accurate photos and description.
- Don't post anything on our Prohibited items list, duplicate ads, misleading content, or contact details in an ad's photos or description (buyers reach you through Goodsoko).
- Every ad is reviewed before it is published. We may decline, ask you to change, pause, remove or limit any ad, or request documents (for example a logbook or title deed), at our discretion and without liability.
- You keep ownership of your content and give Goodsoko a non-exclusive, royalty-free licence to host, display, resize and promote it on Goodsoko and in our marketing while the ad is live and for a reasonable time afterwards.
- Ads stay live for the period of your package and then expire; you can renew them.
5. Seller packages, boosts and payments
- Packages (which set how many ads you can have live) and boosts (extra visibility for one ad) are paid in advance by M-PESA. Prices are in Kenya shillings and include VAT.
- A package or boost starts when M-PESA confirms the payment and runs for the period shown at checkout. When a package ends without renewal, ads above the free limit are paused.
- Payments are non-refundable except where the law requires, where we charged you in error, or where we decide otherwise at our discretion (for example if we remove an ad for a reason that was not your fault). Refunds are returned to the paying M-PESA number.
- We may change prices for future purchases; changes don't affect what you have already paid for.
6. Buying safely
Meet in a safe public place, inspect items before paying, check documents for vehicles and land, and never send a deposit or advance payment to someone you haven't met. See Staying safe. Report suspicious ads using "Report this ad".
7. Messages and conduct
Use Goodsoko messages only to discuss genuine deals. Don't send spam, harassment, threats, scams or illegal content, or scrape, copy or harvest data from Goodsoko. We may review messages reported to us and act on them.
8. Verification
Sellers may submit identity or business documents to earn a verified badge. A badge means we checked the documents provided at that time; it is not a guarantee of the seller or any item.
9. Suspension and closure
We may suspend or close an account, remove ads, or withhold features if you break these Terms, the law, or put others at risk, and where required by law or a lawful request. You may close your account at any time by contacting support.
10. Liability
Goodsoko is provided "as is". To the extent the law allows, we are not liable for losses arising from dealings between buyers and sellers, for content posted by users, or for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2012 or other Kenyan law that cannot be excluded.
11. Changes
We may update these Terms. We'll post the new version here and, for significant changes, tell you by email, SMS or in the app before they take effect. Continuing to use Goodsoko means you accept the updated Terms.
12. Law and disputes
These Terms are governed by the laws of Kenya. Please contact us first so we can try to resolve any complaint; otherwise disputes will be decided by the courts of Kenya.
